Terms of Use the Superscore application

These Terms of Use ('Terms') set out the general rules for using the Superscore social media application supporting sports multimedia (hereinafter 'Superscore' or 'Service').

This application is owned and operated by Sportening B.V. ('Sportening'), a company registered in Netherlands under the address Jan Van Goyenkade 00008, 1075HP Amsterdam, Netherland, tax no NL 861589373B01.

General rules

Access to and use of the Service is solely at your discretion, decision and risk, and solely for you private purpose.

Before using the Service, you are required to read these Terms and comply with them. By registering on the Service, you also accept our Privacy Policy and agree not to use the Service to send spam or scam to other users and promote any sort of violence or other unlawful behavior. Furthermore, you agree to use the application in line with Community Guidelines and accept content moderation provided by Sportening to secure general Sportening policies being followed. If you do not agree to the Terms, The Privacy Policy or Community Guidelines, do not use the Service.

We reserve the right to update these Terms, Community Guidelines and/or Privacy Policy at any time, and if we make such changes, we will notify you, for example by sending you a notification via Superscore or by publishing an updated document.

By using Superscore and the content contained therein, you do not acquire any rights to them, including intellectual property rights, in the case of any Works. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable and revocable license to use Superscore for personal and non-commercial use. Moreover, when using the Service, in particular, it is not allowed to: multiply, modify, block, publicly play and make publicly available outside the Service, in any form and medium of information or materials and works posted on the Service or its part.

If you create or share content on the Service that may be covered by copyright or other intellectual property rights, by accepting the Terms, you grant us a non-exclusive, transferable, sublicensable, royalty-free and worldwide license to copy, create, distribute, host, modify, publicly perform or display, run, translate, use derivate works of your content. This license expires when you remove your content from the Service, what you can do at any time. If you breach the Terms or other applicable related regulations, if you have an Account, we have the full right to suspend your Account or limit its functionality or disable your access to the Service, of which we will inform you about. In the case described above, we also have the right to permanently delete your Account and/or prevent you from reregistering on the Service.

You can use Superscore if you are over 18 years of age. All you have to do is go to the Service and you will have access to the content posted there. You may stop using the Service at any time by leaving the application.

If you are at least 18 years of age or the age of majority in your jurisdiction, whichever is greater, you may use the full functionality of the Service by registering a user account (“Account”). By registering the Account, you represent and warrant that you are of legal age and are not a person barred from accessing or using the Service under the laws of your country of residence or any other applicable jurisdiction. Concerning the access to (closed) groups, the minimum age is set at 18 years.

Account registration

Upon registering and creating an Account, you enter into an agreement with us for the use of the Service for an indefinite period. You can terminate the agreement at any time by deleting your Account.

To create an Account you must register for our Services using your social login (Google, Facebook, Apple ID).

As part of the Account, you can use the full functionality of Superscore, including:

• access to the results and statistics of football leagues, including live scores and matches
• information from the world of football
• access to discussion groups with football fans
• use other features provided by Superscore

Using the Service

By using the Service, you are solely responsible for the correctness, content and form of any data and information provided by you. Providing false data and information, in particular data of third parties, is prohibited.

By accepting the Terms, you agree not to engage in, or support any behavior, and not to use the Service, in particular to:

1. sharing content: violating the Terms or other related rules; discriminatory, fraudulent, misleading or unlawful (or helping someone else to use the Service in such a way); for which you do not have the necessary sharing rights; infringes the rights of others (including intellectual property rights, to personal data), unless an exception or limitation applies under applicable law; containing malicious codes or viruses, spam or such that could disable, overload or disrupt the proper operation, integrity, appearance or operation of the Service
2. accessing data contained on the Service, collecting them using automated means, making attempts to access data - to which you do not have permission, including collecting and processing usernames or passwords to the Service. We reserve all rights against data and text mining;
3. licensing, buying or selling any data obtained from the Service

Content that violates these provisions may be removed, and the Account on which such content appeared may be blocked. In addition, we reserve the right to remove or limit access to content, features, information or services where we believe it is reasonably necessary to avoid or mitigate misuse of the Service or adverse legal and/or regulatory impact on Superscore.

Some parts of the Service may contain additional terms of use, including those of our service providers, which supplement these Terms. By using these services, you agree to be bound by these additional terms.

Advertising content may also be presented or distributed on the Service, however, we do so in accordance with applicable law.

Sportening is designed to never collect or store any sensitive information. Sportening messages and calls cannot be accessed by us or other third parties because they are always end-to-end encrypted, private, and secure.

We reserve the right to modify, suspend or discontinue Superscore at any time without notice, including but not limited to Superscore features and functionalities and related services.

Technical requirements

In order to use Service, it is necessary to have access to the Internet and the device that allows the use of Internet. Superscore application is downloadable on mobile devices who has access to Apple and Play Store which means iOS and Android devices. Minimum iOS version we support is iOS 14 and minimum Android version we support is Android 7. In order to fully experience app user need to have creates one of the social login accounts (Google, Facebook or Apple). We reserve the right to temporarily disable the Service in whole or in part in order to improve it, add services or carry out maintenance work.

Software

In order to enable new features and enhanced functionality, you consent to downloading and installing updates to our Services.

Fees and Taxes

You are responsible for data and mobile carrier fees and taxes associated with the devices on which you use our Services. We don’t charge you to use Superscore or the other products and services covered by these Terms, unless stated otherwise.

Compliant procedure

You have the right to file a complaint in matters related to the functioning of the Service. Complaints should be submitted by e-mail to the following address: help-be@superscore.live , which will be considered within 14 days from the date of its receipt. The response to the complaint will be sent to you at the address provided by you in the complaint.

These Terms will be interpreted and enforced in accordance with Belgian law, regardless of conflict of laws, and any disputes will be resolved by Belgian courts using Belgian law
